Terms of Service

These Terms of Service ("Terms") govern your use of the ParkDwell parking management platform operated by ParkDwell, Inc. ("ParkDwell"). By creating an account, you agree to these Terms.

1. Eligibility
You must be at least 18 years old to create an account.
2. The service
ParkDwell provides software to property managers, HOAs, workplaces, and hotels for managing parking spaces, permits, enforcement, and payments. We make commercially reasonable efforts to maintain 99.5% uptime, with scheduled maintenance announced in advance on our status page.
3. Your account
You are responsible for protecting your sign-in credentials, the actions of users you invite, and the accuracy of the data you upload.
4. Fees & billing
Subscription fees are billed monthly in advance based on your selected plan. Free trials convert to paid plans automatically at the end of the trial period. You can cancel anytime — your data remains read-accessible for 30 days after cancellation.
5. Acceptable use
You agree not to:
- Reverse engineer or attempt to extract our source code.
- Use the service to send unsolicited bulk messages (spam).
- Use the service to discriminate unlawfully against any individual.
- Resell or sublicense the service without our written consent.
6. Resident & parker data
You are the data controller for any personally identifying information you upload about your residents, employees, or guests. ParkDwell is the data processor. Our Data Processing Addendum (/dpa) governs the processing relationship.
7. Termination
Either party may terminate this agreement at any time. We may suspend your account for non-payment or violation of these Terms. Upon termination, you can export your data for 30 days.
8. Disclaimers & limitation of liability
The service is provided "as is." To the maximum extent permitted by law, our aggregate liability is limited to the fees you paid us in the 12 months preceding the claim.
9. Governing law
These Terms are governed by the laws of the State of Delaware. Disputes will be resolved in the state and federal courts located in Delaware.
